"Service" refers to the luxury vehicle rental services provided by eclatsays.

"User," "You," "Your" refers to the individual or entity renting a vehicle from eclatsays.

"We," "Us," "Our" refers to eclatsays and its authorised representatives.

"Vehicle" refers to any luxury car made available for rental through our services.

"Agreement" refers to the rental contract formed between you and eclatsays upon confirmation of booking.

By booking a rental or using our services, you confirm that:

• You are at least 21 years of age
• You hold a valid driving licence recognised in Singapore
• You have the legal capacity to enter into binding agreements
• You have read, understood, and agree to these Terms and Conditions

eclatsays provides luxury car rental services in Singapore, offering:

• Mirror Finish Daily Hire: Daily rental of showroom-condition luxury sedans
• Nightfall Coupé Series: Evening rental programme (4 PM to 8 AM) with dark-finished sport coupés
• Showroom Experience Package: Multi-day vehicle exploration programme with curator service

Vehicle availability is subject to booking confirmation. We reserve the right to substitute vehicles with comparable alternatives if the originally booked vehicle becomes unavailable.

Reservation Process:

• Bookings can be made through our website, phone, or email
• A booking is confirmed only upon receipt of payment and our written confirmation
• We recommend booking at least 48 hours in advance for standard rentals
• Showroom Experience Package requires minimum one week advance notice

Required Documentation: Valid driving licence, identification document (passport or NRIC), and payment method must be provided at time of booking.

Pricing: All prices are quoted in Singapore Dollars (SGD) and include:

• Comprehensive insurance coverage
• Standard fuel allowance
• Delivery and collection (where specified)
• 24-hour support access
• Personalisation services as outlined in each package

Payment Methods: We accept credit cards, bank transfers, and corporate accounts. Full payment is required at time of booking confirmation.

Additional Charges: May apply for:

• Excess mileage beyond agreed allowance
• Specialised cleaning beyond normal use
• Traffic violations or parking fines incurred during rental
• Late return charges

As a user of our services, you agree to:

• Operate the vehicle in accordance with Singapore traffic laws
• Use the vehicle only for lawful purposes
• Maintain the vehicle in good condition during rental period
• Report any damage or mechanical issues immediately
• Not permit unauthorised persons to operate the vehicle
• Not use the vehicle for commercial purposes without written consent
• Not take the vehicle outside Singapore
• Not smoke or allow smoking inside the vehicle
• Return the vehicle on time and in the condition received

Insurance Coverage: All rentals include comprehensive insurance with third-party liability coverage as required by Singapore law.

Excess/Deductible: You are responsible for the insurance excess amount in case of damage to the vehicle. The excess amount will be specified in your rental agreement.

Your Liability: You are liable for:

• All damage to the vehicle not covered by insurance
• Loss or theft of vehicle keys
• Interior damage caused by negligence
• Traffic violations and parking fines

Pre-Rental Inspection: Detailed photographic condition documentation will be provided at vehicle handover. You should inspect the vehicle and report any concerns immediately.

Post-Rental Assessment: The vehicle will be inspected upon return. Any damage beyond normal wear will be documented and charged accordingly.

Failure to report pre-existing damage at time of collection may result in charges for that damage.

Cancellation by You:

• More than 72 hours before rental: Full refund minus 10% administrative fee
• 48-72 hours before rental: 50% refund
• Less than 48 hours before rental: No refund

Cancellation by eclatsays: If we must cancel your booking, you will receive a full refund or alternative vehicle option of equal or greater value.

Our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:

• Uninterrupted or error-free operation of vehicles
• Specific vehicle performance outcomes
• Availability of particular vehicle models at all times

Professional Advice Disclaimer: Any information provided by our team is for general guidance only and does not constitute professional automotive or legal advice.

To the maximum extent permitted by Singapore law:

• Our total liability for any claim arising from your use of our services shall not exceed the amount paid for the rental
• We are not liable for indirect, consequential, or special damages
• We are not responsible for personal property left in vehicles

This limitation does not affect liability that cannot be excluded under Singapore law.

You agree to indemnify and hold harmless eclatsays, its directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the rented vehicle
• Your violation of these Terms and Conditions
• Your violation of Singapore laws or regulations
• Any damage to third parties or property during your rental period

Termination by You: You may terminate the rental early, but no refund will be provided for unused rental time.

Termination by eclatsays: We reserve the right to terminate the rental and recover the vehicle immediately if:

• You breach these Terms and Conditions
• You use the vehicle for illegal purposes
• The vehicle is endangered or improperly maintained
• Payment obligations are not met

Governing Law: These Terms and Conditions are governed by the laws of Singapore.

Jurisdiction: Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

Informal Resolution: Before initiating formal proceedings, parties agree to attempt informal resolution through direct communication.

Entire Agreement: These Terms and Conditions, together with your rental agreement, constitute the entire agreement between you and eclatsays.

Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment: You may not assign or transfer your rights under these terms without our written consent.

Notices: All notices should be sent to [email protected].

We may update these Terms and Conditions from time to time. Changes will be effective upon posting on our website with a new "Last Updated" date. Your continued use of our services after such changes constitutes acceptance of the updated terms.

For existing bookings, the terms in effect at time of booking confirmation will apply.
